Switch Affiliate Terms

These terms are the agreement between you, a creator in the Switch affiliate program, and us: Fallon Ough, a sole trader in Austria, trading as "Switch", Julius-Raab-Straße 10, 4040 Linz, Austria. "We" and "us" mean Switch. English is the contract language.

1. Who can join

• You must be 18 or over.
• You ask to join in our Discord. We decide on every request ourselves, and we may refuse one without giving reasons.
• If we agree, we send you a private sign-up link. You sign up there, confirm that you're 18 or over, and accept these terms. The agreement starts when you've signed up.
• You take part as an independent creator or business. You aren't our employee, agent or partner, and you can't make promises or contracts in our name.

2. Your link and your Discord invite

• When we approve you, we give you your creator link: our address with your name at the end, for example https://www.getswitch.net/c/yourname.
• An order counts for you when the buyer comes to our website through your link and orders within 24 hours. We count the 24 hours from the start of the hour in which they arrived.
• We store nothing in the buyer's browser for this. Your link is carried only in the address of the pages the buyer opens next. If they come back another way, for example by typing our address, the order doesn't count for you.
• Each order counts for one creator at most. If the buyer then follows another creator's link and orders from there, the order counts for that creator.
• A link can't be added to an order afterwards.
• In our Discord, you also get your own invite to our server. Our bot makes it the first time you use the /affiliate command.
• An order also counts for you when the buyer joins our Discord through your invite and orders within 24 hours after joining. For that, their key must be linked to the Discord account that joined (when they order, on their account page, or in our Discord) within 30 days of their payment.
• Discord doesn't tell us which invite someone used. Our bot works it out from how often each invite has been used. So if two people join at the same moment through different invites, or our bot is offline when someone joins, it can't tell, and that join counts for no one.
• If the buyer joined through more than one creator's invite, their last join before the order counts. An order that already counts for a creator's link stays with that creator: an invite doesn't move it.
• Your link and your invite don't change the buyer's price or what they get. Buyers get no discount.
• Your link and your invite are yours alone. Don't sell them, present them as someone else's, or use another creator's.

3. Your commission

• You earn 20% of the first payment of each order that counts for you:
  • for a pass, its price;
  • for a subscription, its first payment only.
• You earn nothing on renewals.
• Commission is worked out on the amount the buyer actually paid, in the currency they paid in (US dollars or euro).
• There's no commission on:
  • your own orders: placed with your e-mail address, paid with a card used on your own orders, or with the key linked to your own Discord account;
  • orders that are never paid;
  • orders that are refunded, or reversed after a payment dispute;
  • orders that come from a breach of these terms, for example from spam or ads on our name.
• Hold: a commission is pending for 30 days after the payment. Then it becomes payable.
• Reversals: if a payment is refunded or lost in a dispute, its commission is cancelled. If we've already paid it, we deduct it from your later commissions.

4. Payouts

• Once a month, we pay out your payable commissions if together they reach at least €20 (or $20, if we pay you in US dollars). If they don't, they carry over to the next month.
• We pay by SEPA bank transfer to accounts in the euro area, and by PayPal or Wise elsewhere, in euro or US dollars. We convert at the European Central Bank's reference rate on the day we pay.
• After we approve you, you send us your payout details by e-mail, and you keep them up to date. If a payout fails because your details are wrong, we try again after you've corrected them.
• We pay the fees for sending. Fees your bank or payment service charges you for receiving or converting are yours.
• Statements and self-billing: with each payout we send you a statement. It's also the invoice for your services, which we issue on your behalf (a self-billed invoice). You agree to that. Tell us within 30 days if anything on it is wrong. If you're registered for VAT, tell us your VAT number.
• Taxes: you're responsible for your own income tax and social security on what you earn. We may ask for information that tax law requires of us, such as your country of residence, and report payments where the law requires it.

5. How you may promote Switch

• Say that it's an ad, every time. Make clear that you earn a commission from us, and say if we gave you a free key. Follow the rules where you live and on each platform: for example "Ad", "Werbung" or "Anzeige", #ad, or the platform's paid-promotion setting.
• Tell the truth. Only say what's true and what our website says. Never say or suggest that Switch:
  • is undetectable, ban-proof, risk-free or safe;
  • guarantees wins, results or ranks, or achieves "average" results;
  • is made, endorsed or allowed by Roblox or by the developers of any game;
  • includes agents or games that aren't released;
  • comes with refunds. Don't invent numbers.
• Don't hide the risk. Using Switch breaks Roblox's Terms of Use, and Roblox or a game may act against a player's account. Never deny that or play it down.
• Not for children. Don't make content for children or aimed at them. Never tell children to buy Switch, or to ask their parents to buy it for them. Switch isn't for anyone under 13.
• No spam and no tricks:
  • no unsolicited messages, fake reviews, bots or bought followers;
  • no posting in communities against their rules;
  • no coupon, cashback or deal sites;
  • no paid search or social ads that use "Switch" or "getswitch.net" as a keyword or in the ad;
  • no websites, accounts or names that could be mistaken for ours.
• Not in our Discord. Don't post your link in the Switch Discord server.
• Follow each platform's rules where you post, such as YouTube, TikTok or Twitch.
• We may check your content. If we ask you to change or remove something that breaks these terms, do it within 48 hours.

6. Your free key

• When you sign up, you get a free Switch key for making your content. Currently it's a Max key for 7 days from its first use, which we renew while the partnership runs.
• It locks to the first PC that uses it, so load it once before you record. Never show it, share it or sell it.
• We may revoke it at any time.
• It counts as something of value from us, so your ads must say you got it (section 5).

7. Our name and logo

• You may use the name "Switch" and the logos we give you, only to promote Switch under these terms.
• Don't change them, and don't make anything look as if it comes from us.

8. Data

• You never get buyers' personal data. In our Discord, the /affiliate command shows you only totals per month: clicks, joins through your invite, orders and commission.
• Don't try to find out who bought through your link or your invite.

9. Ending the agreement

• You or we can end this agreement at any time, by e-mail. We then turn off your link and remove your Affiliate role in our Discord.
• Commissions on orders that counted for you before the end are still paid under these terms.
• If you seriously break these terms, for example section 5, fraud or orders through your own link, we may end the agreement at once. Commissions from orders affected by the breach are then not paid.

10. Responsibility

• You're responsible for your own content.
• If someone makes a claim against us because of your content or your breach of these terms, you cover our reasonable costs and damages.
• Neither of us is liable to the other for lost profit or indirect losses, except for intent or gross negligence, or where the law doesn't allow this to be excluded.

11. Changes

• We may change these terms or the commission for the future. We e-mail you at least 30 days before a change takes effect.
• If you don't agree, you can end the agreement before then. Orders placed before the change keep the old terms.

12. Law and courts

• Austrian law applies, without the UN Convention on Contracts for the International Sale of Goods.
• The courts with subject-matter jurisdiction for our business address have exclusive jurisdiction, unless mandatory law gives you another court.
